Acceptance of Terms
By accessing and using the website www.diversdownuae.com ("Website"), you agree to be bound by these Terms and Conditions ("T&Cs"), all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this site.
Services Offered
Divers Down is a PADI (Professional Association of Diving Instructors) authorized scuba diving center providing: PADI diving courses, guided fun dives, equipment rental, and related services (collectively, the "Services").
Booking, Payment, and Mandatory Safety Requirements
A. Booking Confirmation
All bookings are subject to availability and confirmation by
Divers Down.
A deposit or full payment may be required to secure your
reservation.
B. MANDATORY PADI SAFETY REQUIREMENTS Medical Statement: All
participants in diving activities must accurately complete and submit the
official PADI Medical Statement prior to participation.
Physician Clearance: If the PADI Medical Statement indicates
the need for medical clearance (i.e., answering "YES" to certain
questions), the participant MUST obtain and present written authorization from
a licensed physician before being allowed to enter the water.
Liability Waiver: Participation in any diving activity requires signing a separate PADI Release of Liability and Assumption of Risk Agreement/Waiver. This document is mandatory and supersedes any conflicting T&Cs regarding liability for dive activities.
Divers Down reserves the right to refuse participation to
any individual deemed medically unfit to dive, who fails to provide necessary
medical clearance, or who acts in a manner that compromises their safety or the
safety of others.
C. Cancellation and Refund Policy
Cancellations made within 24 hours and no-shows will be
charged in full. If you complete fewer dives than originally booked, the
original booking will still apply (for example, booking two dives but
completing only one will still be charged as two).
Divers Down Cancellation: Divers Down reserves the right to
cancel or postpone any activity due to adverse weather, unsafe sea conditions,
or other unforeseen operational reasons. In such cases, customers will be
offered an alternative date or a full refund.
Failure to Meet Prerequisites: If a participant is unable to meet course prerequisites (e.g., medical clearance, prior certification level, minimum age, or required water skills), the course provider may offer options such as rescheduling, partial credit, or transfer to a future course. Refunds may be issued at the discretion of the provider, depending on the circumstances.
D. Validity of Packages and Recent Diving Experience
- Validity Period: All diving packages and courses are valid for 12 months from the date of purchase, unless otherwise stated in writing by Divers Down. Unused dives or course components after this period will be forfeited and are non-refundable.
- Recent Diving Experience (Certified Pleasure Divers): Certified pleasure divers must have logged a dive within the last six (6) months prior to participation. If this requirement is not met, Divers Down reserves the right to require a refresher course or check dive, which may be conducted at an additional cost, before allowing participation in diving activities.
User Obligations
You agree to provide true, accurate, current, and complete information during the registration and booking process.
You agree not to use the Website for any unlawful purpose or in any way that interrupts, damages, or impairs the service.
Intellectual
Property Rights
The content on the Website, including text, graphics, logos, images, and course materials, is the property of Divers Down or its content suppliers (e.g., PADI) and is protected by copyright and intellectual property laws.
Governing Law and Jurisdiction
These T&Cs shall be governed by and construed in accordance with the laws of the United Arab Emirates and specifically the Emirate of Dubai.
Any disputes relating to these T&Cs shall be subject to the exclusive jurisdiction of the courts of Dubai, United Arab Emirates.

Extra notes :
- Diving packages and courses are valid for 12 months from the date of purchase.
